Terms of use
These terms apply to the use of the Consation website and accounts. Please read them carefully. By creating an account you agree to them.
1. Scope and provider
Consation is an educational website about consent, communication and safety in relationships, sexuality and BDSM, with optional personal tools. It is provided by John Dieter Jöhr, Im Lägi 2, 8700 Küsnacht, Switzerland ("we").
These terms apply to all use of the website. Reading public content is possible without an account. Using the personal tools requires an account; by registering you accept these terms.
2. Who may use Consation
- You must be at least 18 years old. The content is intended for adults only.
- The date of birth you give at sign-up must be correct.
- Each account belongs to one person. Do not share your login and keep your password safe.
- Tell us without delay if you suspect someone else is using your account.
3. Our service
All content and features of Consation are free of charge. There are no paid plans and no advertising.
We work to keep the website available and accurate, but because the service is free there is no claim to a particular feature set or to uninterrupted availability. We may change, extend or discontinue features. If we plan to discontinue the personal tools, we will let registered users know in good time so they can save their data.
4. Education, not professional advice
The content on Consation is for general education and self-reflection. It is not medical, psychological, therapeutic or legal advice and does not replace advice from qualified professionals. Information can be incomplete or out of date even though we take care when writing it.
Your health comes first
If you have health concerns, injuries, pain or emotional distress, contact a doctor, a counseling service or another qualified professional. In an emergency call your local emergency number (112 in the EU).
5. Safety and personal responsibility
Many practices described on Consation carry physical and emotional risks, some of them serious. Whether and how you try something is your own decision and responsibility, together with the people involved. Every activity requires the free, informed and ongoing consent of everyone involved.
- Only do things you understand and that all participants have agreed to.
- Agree on safewords or signals and respect them immediately.
- Stop at once if someone withdraws consent, is in pain in a way that was not agreed or shows signs of distress.
- Do not engage in risky practices under the influence of alcohol or drugs.
6. Agreements are not contracts
Agreements, contract templates, session plans and signatures created on Consation are communication tools. They help partners talk about wishes, limits and expectations. They are not legally binding contracts, create no enforceable obligations and cannot be used to require anyone to do anything.
Consent can always be withdrawn
No agreement, signature or earlier yes replaces consent in the moment. Anyone can withdraw their consent at any time, without giving reasons, regardless of what was written down.
7. Acceptable use
When using Consation you must not
- pressure, threaten, harass or manipulate anyone, including through partner features or chat
- upload or share content involving minors, or content that is illegal
- share images or personal information about other people without their permission
- pretend to be someone else or create accounts for other people
- use the site to arrange or promote activities without the consent of everyone involved
- send spam, advertising or malicious code, or try to bypass security measures or access other users' data
- collect content or data automatically (scraping) or overload the service
If you notice a violation, please tell us through the contact form.
8. Your content and sharing with partners
Content you create or upload (for example notes, profile text, agreements, files and messages) remains yours. You give us the non-exclusive, free right to store, process and display this content to the extent needed to provide the service to you and to the partners you share it with. This right ends when you delete the content or your account.
You are responsible for your content and for making sure you are allowed to share it. Partners only see what you choose to share and only after both of you have accepted the connection. Please keep in mind that we cannot stop a partner from copying or photographing what they can see. Share only what you are comfortable sharing.
9. Our content
Texts, graphics and the design of Consation are protected by copyright. You may read, print and save them for personal, non-commercial use. Any other use, in particular copying the content to other websites or into other products, requires our prior consent.
10. Liability
We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
Because Consation is provided free of charge, we are otherwise not liable for slight negligence. This does not apply to the breach of an obligation that is essential for achieving the purpose of these terms and on which you may regularly rely; in that case our liability is limited to the typical, foreseeable damage.
We are not responsible for what users do with the information on the site or for the conduct of other users, including partners. The same limitations apply to the personal liability of our representatives and assistants.
11. Ending your use
You can stop using Consation at any time and delete your account yourself in your profile. Your data is then deleted as described in the privacy policy.
We may suspend or delete accounts that seriously or repeatedly violate these terms or the law, or that belong to minors. Where reasonable, we will warn you first and tell you why. Our right to terminate for good cause remains unaffected.
12. Changes to these terms
We may adapt these terms, for example when we add features or the law changes. We will inform registered users of material changes in good time before they take effect. If you do not agree with the changes, you can delete your account before they take effect.
13. Applicable law and final provisions
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside. The place of jurisdiction is Küsnacht (Canton of Zurich, Switzerland), unless mandatory law, in particular consumer protection law, provides otherwise.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
If any provision of these terms is invalid, the remaining provisions remain in effect.
Questions about these terms: support@consation.com or the contact form.
